These Terms apply to the use of the WorkerHomes website and all associated services and content. They govern the relationship between WorkerHomes and the users of the platform, including both accommodation providers ('Providers') and seekers ('Users').

Welcome to WorkerHomes. These Terms and Conditions ('Terms') govern the use of our platform, where accommodations for rent can be listed and found. Please read these Terms carefully before using our services. By using our platform, you agree to these Terms. If you do not agree, you may not use the platform.


2. Description of Services

WorkerHomes offers a platform where Providers can list their accommodations for rent and Users can view these listings. WorkerHomes provides only a directory service. No direct booking or payment processing takes place through the platform.


3. Registration and User Account

To access all the platform's features, Users must register and create an account. Registration is free of charge.

  • Information: Users are required to provide truthful and complete information during registration and promptly update this information in the event of changes.
  • Responsibility: The User is responsible for maintaining the confidentiality of their password and for all activities that occur under their account.

4. Offering and Use of Accommodations

  • Listing Description: Providers must ensure that their accommodation descriptions are accurate, complete, and up to date. All relevant information, including prices, availability, and conditions, must be provided.
  • Legal Compliance: Providers are responsible for ensuring that their listings comply with applicable laws, regulations, and requirements, including local rental regulations.
  • Use of Information: WorkerHomes is not liable for the accuracy of the information provided by Providers. The use of the platform is at the User's own risk.
  • Listing Descriptions: Users are required to accurately and fully describe their listings. Listings that do not constitute a genuine offer but are intended solely to attract the attention of potential customers, or posts containing offensive or otherwise illegal content, will be considered abuse and will be deactivated or deleted by WorkerHomes without prior notice.

5. Costs and Fees

  • Free Use: The basic features of the platform are free of charge. There are no fees for creating and displaying listings.
  • Paid Services: WorkerHomes reserves the right to offer paid additional services in the future. These will only be provided with the User's express consent.
  • Pricing and Billing: All prices are exclusive of VAT. WorkerHomes will issue invoices to paying customers by email only. Additionally, all invoices are available for download in the User Dashboard.

6. Disclaimer of Liability

  • Content on the Platform: WorkerHomes provides the platform 'as is' and 'as available.' No warranty is given for the accuracy, completeness, or timeliness of the content.
  • Liability Disclaimer: WorkerHomes, its legal representatives, and its vicarious agents are only liable for intentional or grossly negligent conduct. For essential contractual obligations (i.e., obligations that are crucial for achieving the purpose of the contract), liability extends to slight negligence, but is limited to the foreseeable, contract-typical, direct average damage. For entrepreneurs, WorkerHomes is liable in the case of grossly negligent breaches of non-essential contractual obligations only to the extent of the foreseeable, contract-typical, direct average damage.

7. Limitation of Liability

The above disclaimer does not apply to liability for damages resulting from injury to life, body, or health. The provisions of the Product Liability Act remain unaffected by the disclaimer.


8. Prohibited Activities

Users may not use the platform for illegal or unauthorized purposes. This includes:

  • Abuse: Users are prohibited from using the platform for illegal activities, including but not limited to fraud, money laundering, or the dissemination of illegal content.
  • Data Protection: The use of the platform must comply with applicable data protection laws. It is prohibited to collect, store, or share personal data of other Users without their consent.

9. Termination and Cancellation

  • Termination by WorkerHomes: WorkerHomes reserves the right to suspend or delete a User's account at any time and without giving reasons, especially in the event of violations of these Terms or misuse of the platform. In such cases, the User is not entitled to a refund of any fees paid. WorkerHomes may terminate the contract with one month's notice. WorkerHomes also reserves the right to delete user accounts that have been inactive for more than 12 months.
  • Termination by the User: Users can cancel their monthly subscription at any time via their user account. The cancellation will take effect at the end of the current billing period. No partial refund will be given for the current month. After cancellation, access to paid features will remain available until the end of the current billing period, after which the User will revert to a free account.
  • Subscription Term and Termination: The term for paid packages is 1 month. The right to terminate for cause without notice remains unaffected. Unless the package is canceled before the end of the contract term, it will automatically renew for the selected term. The User can cancel the contract at any time using the cancellation button. The account will remain active until the end of the current package term or trial period and can still be used by the User during this time. The current billing period must still be paid by the User. WorkerHomes may terminate the contract at any time at the end of the respective contract term.
  • Right of Withdrawal in Accordance with Directive 2011/83/EU:
    • Consumers have the right to withdraw from their contract within 14 days without giving any reason (Right of Withdrawal).
    • To exercise your right of withdrawal, you must inform us by means of a clear statement (e.g., by email or post) of your decision to withdraw from this contract. To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
    • Expiry of the Right of Withdrawal: The right of withdrawal expires in accordance with Article 16 of Directive 2011/83/EU when the service has been fully performed or, in cases where the service begins during the withdrawal period, when you have expressly agreed that the execution of the service begins and you have acknowledged that you will lose your right of withdrawal once the service has started.
    • As the service on WorkerHomes begins with the publication of your listing, your right of withdrawal expires as soon as your listing is published and you have agreed to the start of the service.

10. Data Backup

WorkerHomes implements effective data backups as part of its service provision, but does not provide a general data backup guarantee for the data submitted by the User. The User is also responsible for creating regular backups of their data to prevent data loss. WorkerHomes will exercise the appropriate level of care in delivering the agreed service and will perform data backups with the necessary expertise. However, WorkerHomes does not guarantee that the stored content or data accessed by the User will not be accidentally damaged, corrupted, lost, or partially removed. It is the User's responsibility to take their own precautions to secure their data.


11. Content

The WorkerHomes website contains content primarily uploaded by Users. WorkerHomes will remove content if there are indications that these Terms, applicable laws, or the rights of third parties have been violated. Regarding content uploaded by third parties, WorkerHomes acts merely as a service provider in accordance with § 10 TMG (Telemedia Act). Rights holders, particularly those with copyrights and industrial property rights, can report infringing content and request its removal. WorkerHomes does not guarantee or assume liability for the accuracy of the content posted on the website by third parties.


12. Granting of Rights

For the content (images, listing descriptions) that the User uploads to WorkerHomes, the User grants WorkerHomes a non-exclusive, worldwide, perpetual, unlimited, transferable, and irrevocable right of use in all known forms of use regarding all copyrights and other protective rights. The User undertakes to only upload content for which they can grant such rights to WorkerHomes.


13. Indemnification

The User shall indemnify WorkerHomes against all claims asserted by third parties against WorkerHomes due to such violations. This also includes the reimbursement of necessary legal defense costs. The User undertakes to hold WorkerHomes harmless in the event of a claim.


14. Limitation of Liability

WorkerHomes and its legal representatives and vicarious agents are only liable for intentional or gross negligence. For essential contractual obligations (i.e., obligations that are crucial for achieving the purpose of the contract), liability extends to slight negligence but is limited to the foreseeable, contract-typical, direct average damage. For entrepreneurs, WorkerHomes is liable in the case of grossly negligent breaches of non-essential contractual obligations only to the extent of the foreseeable, contract-typical, direct average damage.


15. Liability Disclaimer

The above disclaimer does not apply to liability for damages resulting from injury to life, body, or health. The provisions of the Product Liability Act remain unaffected by the disclaimer.


16. Choice of Law

Unless mandatory legal provisions under the customer's home country's law prevail, German law shall apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).


17. Final Provisions

Should any provision of these Terms be wholly or partially invalid, this shall not affect the validity of the remaining provisions. In place of the invalid provision, a provision shall apply that comes as close as possible to the economic purpose of the invalid provision.
